Not sure about that, I think people have been charged before for poaching without shooting anything because being caught in the wrong place with a gun was clear enough evidence of intention - its still illegal hunting. Might have changed what the specific charges were though I guess.

Different case when the poachers were off-duty cops though and then there is 'not enough evidence to investigate' or something.
