The burris and leupold are both 1-4 though lol

Yes but Leupold has a better warranty than Burris IMO. Just personal preference, go with what you feel is right.

They are both used, and they both have forever warranty.
Or do you mean when it comes to claiming a warranty with leupold is easier ?

I've heard of more than one account where someone has tried to claim warranty on a Burris and got told it wasn't covered where in the same situation Leupold likely would've fixed or replaced it no questions asked.

This may seem kind of random but it reminds me of something I saw the other day, it was talking about how China might be "breaking" an international treaty banning the testing of nuclear weapons, but technically even if they were doing it they wouldn't actually be breaking any treaty as they never ratified the agreement. Not only that but neither did nearly anyone else who signed it. So a lot of these countries only follow this treaty in principle only, if push came to shove there isn't actually anything to compel them.
In a similar manner I think there are some companies out there who might offer a warranty that looks good, but when it comes to actually claiming it....That is one thing Leupold is well known for, having a great warranty and actually following through with it.

FYI Burris has a forever warranty, and backup is available in NZ. Generally a scope would just be replaced on the spot with a new one from stock as not to make the end user wait while the problem unit is sent it off overseas. (old out of production models are replaced with comparable new models)

Details from their website re warranty

"Every Burris optic is covered by the Burris Forever Warranty™. We will repair or replace your Burris optic if it is damaged or defective. The warranty is automatically transferred to future owners.

    No repair or replacement charge
    No warranty card needed
    No receipt needed
    No questions asked
The Burris Forever Warranty does not cover loss, theft, deliberate damage or cosmetic damage that does not hinder the performance of the product.".
