Ban the tool and not the illegal use of the tool.

Probably because it would be bloody hard to nab someone for doing the illegal transmitting. Much simpler to make it illegal to possess the gear. Again, legislation has not kept up with technology. These days you can get a radio that you can plug into your computer and transmit/receive anything on any frequency from 1kHz to 3.8GHz for about $400.
