ever turn up at your door and ask to do spot checks?
Never happened to me but have heard of people saying they do
Isn't the rule for houses the same as roads?.....
@wirehunt not allowed to shoot inside/from the house? I dont see why....a house is private property, in a car its transporting and covered by specific regs....so cant be loaded, or am I missing something?
:cave:
@tussock, LOL, well as long as it isnt a beer you are drinking...then its oh oh
:o
Though wouldnt an AR15 @ <50m make a huge mess to clear up? Ive never seen what a rabbit looks like after a hit with a 223 ....must try it sometime.....but it might have to be a 308
:evilish:
I shoot out of my windows all the time.
@toby, LOL, you can do lots of things, the Q is, are you in trouble if you get caught...ie you are not supposed to. My brother and I used to with an airgun mind you, we'd set up airfix soldiers / ships and take turns blasting, 4 x 32 scope and binocs in hand....hours of fun watching bits fly...sank a few good models that way....I admit I used to cheat and put bulkheads in....
;)
So its illegal to shoot out of my bedroom window?
I live in the wop wops. I shoot starlings on the lawn from my window. I shoot the occasional possum at 3 in the morning from my window. Sometimes the magpies will sit outside and "sing" at 5am right outside my window...... Is it illegal to shoot out of my window? Buggered if i know and i dont really care because i have reason to do so and its not harming anybody. There is only so much magpie rap i can take, and getting up and shooing them away every 10mins gets old fast. Sometimes i dont put my seatbelt on either.
X distance from roads and/or buildings? But it's been a long while since I've looked, seem to recall 200 metres.
So you ALWAYS know what is coming around the corner at your house?
It's not illegal to shoot out of your window unless you are frightening, annoying or endangering persons or property.
There are no distances etc.
Trust me.
Specifically,
Quote:
Arms Act, section 49
Every person commits an offence and is liable on summary conviction to imprisonment for a term not exceeding 3 months or to a fine not exceeding $3,000 or to both who, without reasonable cause, discharges a firearm, airgun, pistol, or restricted weapon in or near—
(a)a dwellinghouse; or
(b)a public place,—
so as to endanger property or to endanger, annoy, or frighten any person.
I've never found anything in the Arms Act about random inspections, does anyone know what legislation this is covered under if at all?
If not specifically mentioned surely a random inspection requires your consent, otherwise it's an illegal search?
There's this but it's not related to a routine inspection
Quote:
Search and Surveillance Act
18 Warrantless searches associated with arms
(1)A constable who has reasonable grounds to suspect that any 1 or more of the circumstances in subsection (2) exist in relation to a person may, without a warrant, do any or all of the following:
(a)search the person:
(b)search any thing in the person's possession or under his or her control (including a vehicle):
(c)enter a place or vehicle to carry out any activity under paragraph (a) or (b):
(d)seize and detain any arms found:
(e)seize and detain any licence under the Arms Act 1983 that is found.
(2)The circumstances are that the person is carrying arms, or is in possession of them, or has them under his or her control, and—
(a)he or she is in breach of the Arms Act 1983; or
(b)he or she, by reason of his or her physical or mental condition (however caused),—
(i)is incapable of having proper control of the arms; or
(ii)may kill or cause bodily injury to any person; or
(c)that, under the Domestic Violence Act 1995,—
(i)a protection order or a police safety order is in force against the person; or
(ii)there are grounds to make an application against him or her for a protection order.
(3)A constable may, without a warrant, enter a place or vehicle, search it, seize any arms or any licence under the Arms Act 1983 found there, and detain the arms or licence if he or she has reasonable grounds to suspect that there are arms in the place or vehicle—
(a)in respect of which a category 3 offence, a category 4 offence, or an offence against the Arms Act 1983 has been committed, or is being committed, or is about to be committed; or
(b)that may be evidential material in relation to a category 3 offence, a category 4 offence, or an offence against the Arms Act 1983.
I imagine they would revoke your licence because they can't confirm you have a safe way to store the firearms, then they could enter under SAS Act or apply for a warrant.
Could possibly have good cause to suspect from the start but it would be pushing it.
The requirements and details of Inspection periods etc and a whole bunch of other instructions for the Police that pertain to licence administration are in the Police Firearms Manual, not to be confused with the Arms Act or Regulations, but to be refered to in addition.
AO's can and will, turn up unannounced if you have an E cat. They ask permission but. It has happened to me a couple times. They must think I am shifty:D
one interesting paragraph.
The computer system has been set up in such a way that each Firearms Licence carries
an “A” endorsement. This is to enable the recording of sporting long arms when universal
registration of firearms becomes law.
@toby, I agree with savage, not as far as I am aware.
Here is the code,
Arms Code (Firearms) | New Zealand Police
On private property as long as you and everyone else are safe it should be fine. The code is aimed at safety so unless some of the 7 rules are being broken....
Blast away...
:smash:
I've had a firearms licence since 1981 with "B", "C" & "E" endorsements since the early 90's
I live a couple of ks from the local Police station where the area AO is located.
I've never had a spot inspection.
You fellas who have must be dodgy alright. ;)
But I did have the AO leave a message on my home phone this morning .... seems it's relicencing time for me.
Must school the missus up on what to say when I'm asked to leave the room ;)
Last time she told him I had one gun thingy out in the shed somewhere :)
After he'd looked in my safe he said to me "She has no abosultely idea whats out here does she". Kinda best for all concerned if we keep it they way too was my reply.
Cheers
Pete
I highly doubt that it would stand up in court if you refused to let an officer who showed up on your doorstep do a spot inspection then t hey took that as grounds to revoke your license and search the place anyway. I am not a lawyer but that seems like a gross breach of our freedoms
Not in any legislation I've seen. There is the guideline of 'not within 500meters of a track on DoC land' which isn't in the legislation but the Conservation Act allows Hunting Permits to be issued subject to any conditions the director general thinks fit, so if it's a condition if the permit, you're breaking the law if you break that condition.
I don't have a permit in front of me to check what conditions are on it.
A few years back after I changed address I had 2 uniformed cops do a spot inspection
@P38 so they re-interview ppl when you apply for a new licence?
Yep
You have to fill in the re-application forms and submit them with passport photos and a reciept for $126.50 via the AO to the Area Commander for sign off.
On those re-application forms you must nominate all the people who live at your address, next of kin etc and another person "Your Character Witness" who has a firerms licence, is not related and does not live at your address and ahs personally know you for more than two years.
The re-licencing inspector will, Interview you, inspect your security, record the serial numbers of all "B", "C" & "E" cat firearms in your possession (these must match their records or look out) He does not have the right to record the serial numbers of any other firearms you have in your posession but he will ask if he can and hold this information on your behalf for "Insurance Purposes" , Yeah Right!. He will then interview the Adults who live at your address and ask if your a Drunk or a Druggy or Violent or Suffer from depression or have had any Head Injuries etc. They will also interview your Character Witness.
If all goes well a few weeks later a new 10yr licence turns up in the post or the AOS arrives, surrounds the house, negotiates a surrender or storms the house (their choice apparently) with tear gas and dogs, arrests your sad arse, impounds your arsenal of weapons and cache of ammo and it's off to Jail for you where bubba becomes your new best friend. :)
Pretty simple really.
Hope this helps.
Cheers
Pete
LOL....must get some Vaseline then...
didnt realise they bothered with all this again!
doh
Yep they do. went through all of that just last year. The AO was a really hot looking chick so of course I had to let the lady go first up the steps to the attic and it took me ages to get the safe open.
That sounds like her.
Yup Brenda. I had John who had difficulty getting in/out of the RAV4. But he did mention the other AO is way better looking than him :D
Then she reads about this talk here you guys may get lucky next visit
Is not anywhere the public has access to a public place?
We all had to get f endorsement on our licences to use em in our yard because the public could walk or drive in
