Once again I think there should be a "Possession with Criminal Intent" rule with some sort of mandatory sentence. In this case his only reason to have the weapon was probably to defend his drugs or on sell to another criminal. Unlawful possession is more for someone who got their Grandfathers gun and never got a license or hunters with no license (yes they are out there) etc.
There's no need for that. That's why the penalties span so far. To reflect the seriousness of the crime.
