+1 he's proved to be extremely unreliable and economical with the truth. Completely justified hanging onto it until tribunal. Make sure you keep a record of EVERYTHING. Every email, time and dates of phonecalls (even the ones he doesn't answer), get the dates (drop off, booking date etc) from the courier company.

And at the same time he will use this info?? Thought he asked it back for inspection, my money is he is waiting for rifle and this is what small claims will hear and my feeling is they will rule in his favour as you have not given him a chance to fix it by not sending back?? Assume you have his address?? He will be waiting for it jn post, small claims are better once all steps are followed and still not happy. Just my 10c

Good luck and hope for a positive outcome either way.

I'm hoping he will use this info.

They may agree 're giving him a chance and I'm fine with that. But theres several facts that may counteract that sole defence of his. One of them being I have no bloody idea where to send it. I've asked and he will not give it. I want the address from him so I know it's going to exactly where he wants it. But there'ss till more to it than that.

I will be in the market for a new rifle/scope/other stuff, in December. Won't even bother looking at this guy after all this. Possibly his loss of my hard-earned. Thanks Grunta. Hope it's all sorted for you soon.

This guy keeps getting classier and classier. Im surprised he even knows how to run a business. I think I was justified in not sending the rifle back to him until he gave me an address. The court documents were sent to his business/home address and surprise surprise I recieved a letter from the courts saying the address was not valid - he's obviously just sent them back without opening them. If he's got nothing to hide or feels he's done no wrong, then why not man up and have your say in court? Luckily I'm patient. Roll on the next step.

But a word of warning to anyone, do not trust this guy, Im not the first to have issues, and im sute I wont be the last.

@TianBotha - I gave up chasing him. The court system annoyed me in the end too. If there was more $$ involved I would have kept going, but the final straw was when I was told the hearing was going to be postponed because he was not served with the papers as he kept sending them back, but there was a communication break down at the court house admin department and the hearing did go ahead but as I was told it was postponed I didn't turn up, and good old cock face mackenzie certainly didn't put an appearance in either so it was dismissed. For me to get them to still proceed with it it I had to fill in more paper work and I couldn't be arsed in the end.

Lesson learnt though, I'll never buy a firearm sight unseen now, or at least not from an unknown homo.
