They recently requested information via the official information act regarding what police are doing with regards to the arms bill rewrite. The response was basically you won't be told anything till it's too late to do anything about it.

Basically NZPHQ are swinging their d*cks about now, after a hiatus since the 2013 Arms Act Changes.
I recon some Senior NZP officer finally said, enough of being doormats, we've created a mess in the fallout from the thumbhole debacle in 2009, so lets be d*ckheads, because we can.

All part of their recent agenda in the media to drum up public concern about firearms in NZ and make further changes to the Arms Act.

Basically, they are, because they can:


18 Issue of permits to import firearms, parts of firearms, or
restricted airguns
(1) Any member of the Police to whom application is made for
the issue of a permit for the purposes of section 16(1)—
(a) may require the applicant to produce for examination
and testing such samples of any firearms, pistols, military
style semi-automatic firearms, starting pistols, restricted
airguns, or restricted weapons of any kind referred
to in the application as the member of the Police
may consider necessary; and
(b) may, in the discretion of that member of the Police,
refuse to grant the permit with respect to—
(i) any firearm, pistol, military style semi-automatic
firearm, starting pistol, restricted airgun, or restricted
weapon of any kind; or
(ii) any parts of a firearm, pistol, military style semiautomatic
firearm, starting pistol, or restricted
weapon of any kind.
(2) Without limiting the discretion conferred by subsection (1)(b),
no application for a permit for the purposes of section 16(1) in
respect of—
(a) a pistol, military style semi-automatic firearm, restricted
airgun, or restricted weapon; or
(b) parts of a pistol, military style semi-automatic firearm,
or restricted weapon,—
shall be granted otherwise than by the Commissioner who
shall first be satisfied that there are special reasons why the
pistol, military style semi-automatic firearm, restricted airgun,
or restricted weapon or parts to which the application relates
should be allowed into New Zealand.
(3) Any permit issued for the purposes of section 16(1) is personal
to the person to whom it is issued and may not be transferred
to any other person.
(4) Any permit issued for the purposes of section 16(1) may be at
any time revoked by a commissioned officer of Police.
(5) A permit for the purposes of section 16(1) is in no case to
be granted in respect of an anti-personnel mine or a cluster
munition.

COLFO also told me:

The Police do have the right to refuse an import permit if the reason is not special. A special reason for importing is any reason that is not normal.

So make any permit application a special case, say the parts are needed as spares for competition etc, NOT for building or even modifying a MSSA (as I said).

Funny I just made a call about that and got told the very same thing!

Well no, that can't impose conditions on the issue of the permit, other than submitting it for examination. They can only refuse to issue it.

The power to impose conditions is mentioned elsewhere in the Arms Act (e.g. s32.2), but not in relation to s18.

A special reason is only required for pistols, MSSAs and restricted weapons.

If they refuse to issue it, you have the right to appeal that under section 62.

Mid-July, AO emails suddenly and said he's wants me to resubmit my last permit again. Emailed him back said I'll do that when I'm back in the country. Received it end-July with only the condition to be a member of a pistol club which is inconsequential since I have my B anyway. But the requirement to serialise my upper receiver has been removed. But the date on my permit is still back-dated to the original application.

I got a permit for an MSSA upper the other day with no conditions.

Future ref if anyone has trouble like this and wishes for it to be sorted by the NSA I can assist you in getting it sorted by The man himself.

Ever vigilant

I have recently received import permits for MSSA parts within weeks of application (two within 3 days, well from date of application to date on the permit)...
All without conditions.
I have one in now and will see how long that takes..
