If he had sorted and washed undersized scollops on board and was leaving the fishing grounds He clearly intended to keep them.

    Take his boat I say!

When I'm sorting scallops its in legal the bin, smalls over the side not washed and put aside....... 133 of them!! ..that's a lot of undersized scallops...I seriously doubt you would get that in one drag...so why not dump them whist you are dragging the next tow ?

Instead you seperate them and give them a wash? Seems like a bit of effort for something your going to ditch over the side.

There has to be something more here than meets the eye here. Over zealous Officers I would doubt, the training regime is pretty through. Non compliant and obstructive plaintiff, residual offender, his intent with his catch. The forfeiture of his $50k boat seems way over the top for an offence of this size for that many scallops and a first time offender.

In a written decision, Judge David Ruth said McKinney's evidence was "unlikely, nonsensical and unrealistic".
Judge made the decision based on what was presented to him. Looks like the cries from the public on "get tough on offenders, no more wet bus tickets" seems to not please everyone.
