Thread: Why bother with justice system?

HI all
This just amazes me, illegal pistol and sawn off shotgun , shoot up a house and no-one goes to jail. WTF. If a licenced firearm owner did this they would end up in jail, this lot get discharged and home D for 10 & 11 months. I thought law was about the facts, but this woke judge is a powder puff, what would the charge be if they had connected with a human, an accident? Talk about a two tiered justice system!

Discharge without conviction - FFS - This was for possession of two guns, a pistol and a sawn off shotgun. One is illegal and the other very tightly controlled and not even allowed to be possessed by a normal FAL.

On top of all this the guy is 22 years old, so can hardly say a misled youth.

The system is a joke - The judiciary are making an absolute mockery of the law - I get caught with an unlocked firearm, accidental, in the house - I lose my FAL - this guy participates in a house shoot up, deliberate, and gets a discharge.

There really does need to be an explanation here.

No words to describe it, waiting for the defenders of the judiciary to explain this one...

This article riled me more than usual. Two days ago, I defended a discharge without conviction, which I must say is still a very light touch sentence and the judge in that case was very lenient.

The basis for that decision is the absence of criminal intent. In today's case, criminal intent is everywhere. Revenge, pistol and sawn off shotgun, and deliberately shooting at a house in a suburban setting, with no consideration for where the bullets end up. The icing on the cake is that not only is the sentence a wet bus tickets, but all of the offenders get permanent name suppression too!

I really hope this is raised at election time, and every one of these woeful sentences is brought up and the government held to account.

Much as I really hate c***y boy Nash - someone should send him that article - I suspect someone already has - He surely couldn't resist picking up the phone again to his mate, if his views are genuinely held.

A thought just occurred to me, whether judges are under threat or pressure from criminal elements, leading to the most lenient sentence possible. That would certainly make sense in this case, especially with the name suppression aspect.

How else does one explain it? I'm struggling to understand how you can avoid jail after shooting up a suburban house with illegal firearms. Taking counselling doesn't explain it, especially in light of the much more stringent controls over firearm licence holders.

It is likely explained by the nuanced approach taken by the Judge and the associated reports and back ground that you are not privy to. For someone who works in the justice system I would have thought you would have considered that.

back in the day there is a " sentencing guidance" each week when my cousin was a lawyer a while back it was known each week there was only a certain amount of space in the prisons and in the system to deal with all levels of crime and this "affected" the sentence given
(eg Budget problems each pedophile can have a budget of up to $250000.oo pa for 24/7 observation...) and then add in the variation in judges own innate pre disposition to leniceny etc.....
And policticans are known not to like having a high prision population as it can be used against them as the system the preside over appears to be a social failure because there are so many criminals....
and I am sure many other factors...
